Terms Of Service

TLZ Built Lighting

These Terms of Service ("Terms") govern your access to and use of the TLZ Built Lighting website, products, and services. By accessing this website or placing an order, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services. 

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from TLZ Built Lighting. By placing an order, you confirm that you meet this requirement. 
 

2. Limitation of Liability & Product Warranty Disclaimer 
Intended Use Warning
FOR OFF-ROAD AND NON-HIGHWAY USE ONLY. TLZ Built Lighting products are designed, sold, and intended solely for off-road, closed-course, and non-street-legal applications. These products are not certified for use on public roads or highways and may not comply with Federal Motor Vehicle Safety Standards (FMVSS), DOT regulations, or the vehicle lighting laws of your state or country. 

By purchasing, installing, or using our products, you acknowledge and agree that:

  • It is your sole responsibility to determine whether use of this product on your vehicle complies with the laws and regulations of your jurisdiction, including on-road/off-road use restrictions.

  • You will not install or use this product in a manner that violates applicable federal, state, or local law.

  • This warning is a material term of your purchase and is not superseded by marketing images, vehicle photos, or installation content showing on-road use.


Limitation of Liability 
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: 
1. Cap on Liability. TLZ Built Lighting's total cumulative liability arising out of or related to any product, this website, or these Terms — whether based in contract, tort (including negligence), strict liability, or any other legal theory — shall not exceed the amount you paid for the specific product giving rise to the claim. 

2. Exclusion of Certain Damages. 
In no event shall TLZ Built Lighting be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of vehicle use, towing costs, loss of income, or diminished vehicle value, even if we have been advised of the possibility of such damages. 


3. Specific Exclusions. Subject to the carve-outs below, TLZ Built Lighting is not liable for damages, injury, or legal violations arising from: 

  • Improper, non-professional, or negligent installation of the product

  • Use of the product on public roads or in any manner inconsistent with the Intended Use Warning above

  • Modification of the product from its original design

  • Compatibility issues, wiring conflicts, or damage to a specific vehicle's electrical system arising from installation by the buyer or an unauthorized third party

  • Normal wear and tear, or exposure to conditions outside the product's rated specifications (e.g., submersion, extreme heat)


4. Carve-Outs-What Cannot Be Waived. Nothing in this section limits or excludes liability for: 
 

  • Death or personal injury caused by our gross negligence or willful misconduct

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded or limited under applicable law (including certain consumer protection statutes)


Warranty Disclaimer 
Except for any express written warranty separately provided with your product,
all products are sold "AS IS" and "WITH ALL FAULTS." TLZ Built Lighting disclaims all other warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some states do not allow the exclusion of implied warranties, so this exclusion may not fully apply to you, and you may have additional rights under your state's law.

Installation & User Responsibility
Products should be installed by a qualified individual familiar with automotive electrical systems. TLZ Built Lighting is not responsible for damage resulting from improper wiring, grounding, or installation. Installation instructions, where provided, are for reference only and do not constitute a guarantee of compatibility with your specific vehicle make, model, or year.

Indemnification
You agree to indemnify and hold harmless TLZ Built Lighting, its owners, and employees from any claims, damages, liabilities, or legal costs arising from your use or misuse of the product, including any use that violates the Intended Use Warning above or applicable law.

Severability
If any provision of this section is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

By using this website and purchasing our products, you acknowledge and agree that you are doing so at your own risk. This limitation applies even if TLZBuilt Lighting has been advised of the possibility of such damages.

3. Governing Law and Dispute Resolution 

These Terms of Service, and any dispute arising out of or related to them or your use of our website or services, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Where applicable law requires the application of the laws of another jurisdiction (including the mandatory consumer protection laws of your country of residence), such laws will apply solely to the extent required. 

Agreement to Arbitrate 
You and [TLZ Built Lighting] agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of our website or services, or any products or services purchased through our site (each, a "Dispute") shall be resolved through binding, individual arbitration, rather than in court, except that either party may bring an individual action in small claims court. 

This agreement to arbitrate is intended to be broadly interpreted and includes, without limitation:

  • Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect.

  • The arbitration will be conducted by a single, neutral arbitrator.

  • Unless you and we agree otherwise, the arbitration will be conducted in [insert county, e.g., Los Angeles County], California, or, at your election, remotely via videoconference or based on written submissions.

  • The arbitrator's decision will be final and binding, and may be entered as a judgment in any court of competent jurisdiction.

  • Each party will be responsible for its own attorneys' fees and costs, except as otherwise provided by the AAA rules or applicable law.
     

Arbitration Procedure 

  • Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect.

  • The arbitration will be conducted by a single, neutral arbitrator.

  • Unless you and we agree otherwise, the arbitration will be conducted in [insert county, e.g., Los Angeles County], California, or, at your election, remotely via videoconference or based on written submissions.

  • The arbitrator's decision will be final and binding, and may be entered as a judgment in any court of competent jurisdiction.

  • Each party will be responsible for its own attorneys' fees and costs, except as otherwise provided by the AAA rules or applicable law.
     

Class Action Waiver 
You and we each agree that any Dispute will be brought on an individual basis only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this Class Action Waiver is found to be unenforceable as to a particular Dispute or a particular form of relief, then that Dispute or that request for relief (and only that Dispute or request for relief) shall be severed from the arbitration and may be brought in court, while the remainder of the Dispute proceeds in arbitration. 

Opt-Out Right You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to [tlzbuilt@gmail.com], including your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts identified below. 

Exceptions to Arbitration Notwithstanding the above, either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the site, or intellectual property infringement, without first engaging in arbitration. 

Venue for Non-Arbitable Disputes For any dispute not subject to arbitration (including opted-out disputes or claims properly brought in small claims court), you and we agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Los Angeles County, California. 

Severability  If any provision of this Governing Law and Dispute Resolution section is found unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
 

4. Governing Law and Dispute Resolution — European Buyers

This section applies to buyers located in the European Economic Area ("EEA"), the United Kingdom, or Switzerland ("European Buyers"), and supersedes the general "Governing Law and Dispute Resolution" section of these Terms of Service where the two conflict. 

Your Right to Bring Claims in Your Home Courts
Nothing in these Terms deprives you, as a consumer, of the protection afforded by mandatory provisions of the law of your country of residence. In particular, you retain the right to bring any dispute before the courts of the EU/UK member state in which you are domiciled, and we may only bring proceedings against you in the courts of the member state in which you are domiciled.

No Mandatory Arbitration for European Buyers
The mandatory, binding arbitration and class action waiver provisions set out elsewhere in these Terms do not apply to European Buyers. Instead, European Buyers may pursue disputes through the courts as described above, or through the alternative dispute resolution options described below. 

Online Dispute Resolution (EU Buyers)

If you are a consumer resident in the EU, you may access the European Commission's Online Dispute Resolution ("ODR") platform at ec.europa.eu/consumers/odr, which allows consumers to submit complaints for out-of-court resolution. Our contact email for ODR purposes is [tlzbuilt@gmail.com]. 

Alternative Dispute Resolution (UK Buyers)
If you are a consumer resident in the UK, you may be entitled to refer a dispute to an approved Alternative Dispute Resolution ("ADR") provider. We are [not currently signed up to] an ADR scheme; you may also bring a claim through the UK courts at any time.

Statutory Rights Unaffected
Nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence, including any rights relating to the quality, fitness for purpose, or conformity of goods purchased, which cannot be excluded or limited by agreement. 

Severability
If any provision of this section is found unenforceable under the law of your country of residence, that provision will be enforced to the maximum extent permitted, and the remainder of this section will remain in effect.

5. Pricing, Promotions & Discounts
Prices, promotions, and product availability may change at any time without notice. 
​Discount codes and promotional offers may not be combined unless explicitly stated. 

We reserve the right to limit quantities, cancel orders, or revoke promotions if abuse or misuse is detected. 
 

6. Shipping & Delivery

Shipping times are estimates and are not guaranteed. 

TLZBuilt Lighting is not responsible for delays caused by shipping carriers, customs processing, weather conditions, or other circumstances beyond our control. 

Risk of loss and title for purchased items transfer to the customer once the order has been delivered to the shipping carrier. 

 

7. Warranty & Repairs
If offered, warranty coverage and repair services are governed by our separate Warranty Policy. 
TLZBuilt Lighting Reserves the right to approve or deny warranty and repair requests based on eligibility, product condition, and availability of replacement materials or components.  
 

8. SMS Communications

If you opt in to SMS communications, you consent to receive marketing and transactional text messages from TLZBuilt Lighting.

Consent to receive SMS messages is not required to make a purchase.

Message frequency may vary. Message and data rates may apply. To unsubscribe from SMS communications, reply STOP to any message. 

9. Intellectual Property
All content on this website, including product designs, images, logos, text, graphics, branding, and other materials, is the property of TLZBuilt Lighting and is protected by applicable intellectual property laws. 

Content from this website may not be copied, reproduced, distributed, modified, or used for commercial purposes without prior written permission.  

10. Website Use
You agree not to use this website for any unlawful purpose or in a way that may damage, disable, disrupt, or interfere with the operation of the website. Unauthorized attempts to access restricted areas of the website functionality are prohibited.  
 

11. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. 

Any dispute arising from these Terms or your use of the website shall be resolved under the laws of that state. 

 

12. Changes to These Terms

TLZBuilt Lighting may update these Terms from time to time. 
 

Updated versions will be posted on this page with a revised Effective Date. Continued use of the website after or updates are posted constitutes acceptance of the revised Terms.
